Action Timeline

January 10, 1994 – A Center member petitioned the U.S. Fish and Wildlife Service to list seven rare swallowtail butterflies under the Endangered Species Act.

May 12, 2004 – With no federal action taken to save the seven swallowtails, the Center sued to force the Service to respond to the 1994 petition.

December 9, 2004 – The Service determined that five of the seven species warranted listing, but that listing was precluded by other priorities. The species were put on the “candidate list” to await protection indefinitely.

February 8, 2006 – The Center filed a notice of intent to sue the Service to force listings for all five candidate butterflies.

November 16, 2006 – The Center sued to force protections for the butterflies.

April 2007 – The Fish and Wildlife Service published a new finding, again declaring that the swallowtails’ listing was warranted but precluded by other listing priorities.

January 2008 – The Center filed suit once again to force protection for the five butterflies. Unfortunately, the court did not force the Service to take action on its “warranted but precluded” findings.
